1. Acceptance of Terms

Welcome to OntiCards. By accessing or using our website, products, or services for the first time, you acknowledge that you have read and agree to be bound by these Terms of Service.

If you do not agree to any part of these terms, please stop using our services.

2. Service Description

OntiCards is a data ontology modeling and data governance platform that provides data card management, relationship modeling, intelligent data querying, and data service API capabilities.

Our services include: the official website (onticards.com), open-source community edition, enterprise edition, and FDE (Full-stack Data Engineering) consulting services.

The specific service scope of the enterprise edition is subject to the subscription agreement signed between you and us.

3. Open-Source License

OntiCards community edition is released under an open-source license. The specific license terms are defined in the accompanying LICENSE file.

Within the scope of the open-source license, you may freely use, modify, and distribute the community edition product, provided you comply with the attribution, disclaimer, and other requirements in the license agreement. The open-source license does not grant trademark rights.

4. Enterprise License

OntiCards enterprise edition is a commercially licensed product that provides private deployment, SSO single sign-on, audit logs, and other enhanced capabilities.

Use of the enterprise edition requires a separate enterprise license agreement. The specific license scope, fees, service levels, and other terms are governed by that agreement. In case of any inconsistency between these Terms of Service and a signed enterprise agreement, the enterprise agreement shall prevail.

5. Acceptable Use

When using our services, you agree not to:

(1) Use the services for any purpose that violates applicable laws or regulations;

(2) Upload or transmit any content containing malicious code, viruses, or harmful data;

(3) Reverse engineer, decompile, or disassemble the services without authorization (except for open-source code within its license scope);

(4) Attempt to disrupt, interfere with, or breach the security mechanisms of the services in any way;

(5) Automated bulk scraping of website content without authorization.

We reserve the right to restrict or terminate service access for violations of the above commitments.

6. Intellectual Property

The intellectual property of the OntiCards platform, website content, brand identifiers, and other assets belongs to OntiCards or its rights holders.

The intellectual property ownership of open-source code is governed by its accompanying license agreement. The intellectual property of enterprise edition products is governed by the enterprise license agreement.

Without our written permission, you may not use the "OntiCards" name or logo in a manner that implies affiliation with or endorsement by us.

7. User Content

Information you submit to us through the contact form remains your property. We only use this information to the extent necessary to respond to your inquiry and improve our services.

You warrant that the information you submit is true, accurate, and does not infringe upon the lawful rights of any third party. You are solely responsible for any liability arising from inaccurate or infringing information you submit.

8. Disclaimer

This website and open-source products are provided on an "as is" and "as available" basis. We make no express or implied warranties.

To the maximum extent permitted by applicable law, we make no warranties regarding merchantability, fitness for a particular purpose, or non-infringement of the services.

You should independently evaluate whether the open-source product meets your needs. Service guarantees for the enterprise edition are subject to the enterprise license agreement.

9. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of or inability to use our services.

Where applicable law does not allow complete exclusion of liability, our cumulative liability shall not exceed the total fees you actually paid to us in the 3 months preceding the event giving rise to the dispute (if any).

10. Service Changes & Termination

We may modify or discontinue all or part of our services at any time, with reasonable advance notice.

You may stop using our services at any time. We reserve the right to suspend or terminate service access for violations of these terms.

After service termination, we will process your relevant information in accordance with this Privacy Policy.

11. Governing Law

The formation, effectiveness, interpretation, and dispute resolution of these Terms of Service shall be governed by the laws of the People's Republic of China (excluding the laws of the Hong Kong Special Administrative Region, the Macau Special Administrative Region, and the Taiwan region for the purposes of these terms).

Disputes arising from these Terms of Service shall first be resolved through friendly negotiation; if negotiation fails, either party may bring a lawsuit before a court with jurisdiction at OntiCards' principal place of business.

12. Terms Changes

We may revise these Terms of Service from time to time. After an update, we will publish the latest version on this page and update the "Last updated" date.

Continued use of our services constitutes acceptance of the revised terms. If you do not agree to the revised terms, please stop using our services.
